The Bar Council of India (BCI), under its authority from the Advocates Act, 1961 and Rule 36, Chapter II, Part VI of the BCI Rules, has strictly banned lawyers from advertising their services, using social media influencers, or promoting themselves in a misleading way.
After the Madras HC judgment on July 3, 2024, and the SC ruling in A.K. Balaji v. Union of India (2018), the BCI issued a directive instructing strict action against lawyers and online platforms violating advertising rules.
The court ruled that these online platforms cannot claim protection under Section 79 of the IT Act, 2000.
Hence, any violation will result in strict penalties, including suspension, cancellation of enrollment, and contempt proceedings.
