Can a Child Obtain an OBC Certificate From Their Mother? Supreme Court to Consider

The Supreme Court has raised concerns over the Delhi Revenue Department's Guidelines that children can only obtain an OBC certificate by presenting their father’s or paternal relative’s caste certificate. 

A PIL challenged this as a violation of a child’s right to equality (Article 14) and personal liberty (Article 21), especially for children raised by single mothers.

The Court referred to its 2012 ruling in Rameshbhai Dabhai Naika v. State of Gujarat, which held that caste must be based on upbringing, not just paternal lineage.

Noting conflicting past judgments, such as Rumi Choudhary and Smriti Monsoon, the Court listed the matter for a detailed hearing on July 22.
