What is Impeachment?

Impeachment is a formal process to remove high-ranking public officials, such as the President, judges, or governors, for misconduct or violation of constitutional duties.

Under Article 61, either House of Parliament may initiate impeachment proceedings against the President for "violation of the Constitution." A 14-day notice, backed by at least one-fourth of members, and a two-thirds majority vote in each House are required.

Similar procedures apply to Supreme Court and High Court judges under Articles 124(4) and 217.

The first originating House investigates the charges, and the other conducts its inquiry, with the official entitled to legal defence.

The upcoming monsoon session is expected to focus on the impeachment motion against Justice Yashwant Varma. And so far, no Indian President has been impeached.
