10 Years Too Late: Allahabad High Court Rejects Husband's Last-Minute Plea to Amend Divorce Petition

The Allahabad High Court rejected a husband's plea to amend a divorce petition after 10 years, calling it a misuse of the legal process to delay proceedings and harass the wife. 

The husband sought restitution of conjugal rights only when final arguments were scheduled, despite knowing the facts since 2014.

The Court stressed that amendments under Order VI Rule 17 CPC require "due diligence," which was absent here. The court also criticised the Family Court for allowing the plea despite prior directions to conclude the matter. 

The High Court has now ordered the divorce case to be completed within two months.
