
The Bombay High Court has strongly criticized the BMC for illegally demolishing a structure providing temporary shelter and food to cancer patients near Tata Memorial Hospital.
Calling the act “insensitive” and done in “unholy haste”, the Court imposed a ₹2 lakh penalty on the civic body and ordered it to provide 1,319.97 sq. ft. of alternate space within four weeks.
Justice Gauri Godse held the demolition a violation of natural justice and Article 51-A, noting that no notice or hearing was given as required under the Mumbai Municipal Corporation Act.
The court condemned BMC’s high-handed approach in handling the matter.
