Supreme Court Doubles Permanent Alimony to 50,000 , Sets New Alimony Rule

  • Case Name: Rakhi Sadhukhan v. Raja Sadhukhan

The Supreme Court, invoking Section 25 of the Hindu Marriage Act and Article 142 of the Constitution, has increased permanent alimony from ₹20,000 to ₹50,000/month with a 5% automatic hike every two years.

The court upheld the transfer of the marital home and directed the husband to clear outstanding loans. The court emphasized lifestyle continuity post-divorce, rejecting claims that remarriage or family obligations reduce responsibility.

The court also called for detailed income scrutiny, including past earnings and hidden assets, to ensure just maintenance. Alimony must match marital living standards, not subsistence. The matter will be heard next on August 28, 2025.
