A breakup between the consenting couple cannot lead to a rape case: SC

The case was about claims that a man raped a woman after promising to marry her, with the relationship lasting almost ten years. (Case filed under Section 376 of IPC). 

It was argued that the claim was false and only came up after the man stopped giving the woman financial support.

The SC said there is an increasing misuse of laws like this, and the long-term relationship without any objection shows that it was consensual, not forced. So, the court rejected the woman’s claim.

Last week, the SC also ruled that just because a couple breaks up doesn’t mean criminal charges can be filed against one person. (Prashant v. State of NCT of Delhi).
