Firm Seeks Replacement Of Retired Supreme Court Judge For Delay In Award: Delhi High Court

The Delhi High Court heard a petition filed by a private firm seeking termination of the mandate of a retired Supreme Court judge acting as a sole arbitrator, citing a delay of over sixteen months in the delivery of an arbitral award.

The award had been reserved in July 2024 and remained pending, and the petitioner contended that the arbitrator’s mandate had already expired more than forty days earlier. The petition, filed under Section 14 of the Arbitration and Conciliation Act, sought substitution of the arbitrator.

Justice Subramonium Prasad described the request as an “embarrassing plea” but granted a short adjournment for further hearing.
