
The Supreme Court refused to interfere with the Delhi High Court’s decision upholding an arbitral award of about ₹66.31 lakh in favour of Aakash Educational Services Ltd. in a franchise dispute involving its Pathankot coaching centre.
The dispute arose after alleged payment defaults and termination of a 2016 franchise agreement with Paramount Learning Solutions.
The franchisee argued that the arbitral award was contrary to the contractual terms and suffered from patent illegality.
However, the Bench of Justices P.S. Narasimha and Alok Aradhe declined to interfere, effectively affirming the High Court’s view that courts cannot reassess the merits of arbitral findings unless statutory grounds for interference are clearly established.
