
The Delhi High Court has held that if an accused does not respond to the questions asked by the investigating officer or refuses to make a confession, his actions cannot be deemed as non-cooperative.
The Court further stated that the accused has the right to defend himself and took note of all the questions the accused had answered which were the matter of trial.
The case dealt with a petition for anticipatory bail filed by a man who was accused in an extortion case filed by a contractor with whom he had entered into an agreement for demolition and reconstruction of a house.
