Acquittal Under Essential Commodities Act Doesn’t Automatically Entitle Trader to Interest: Kerala HC

The Kerala High Court has held that an acquittal under the Essential Commodities Act, 1955, does not automatically entitle a trader to interest or enhanced compensation under Section 6-C of the Act.

The Court observed that while compensation may be payable for unlawful detention of goods, entitlement to interest or higher compensation depends on the specific facts and requirements of Section 6-C, and cannot be inferred merely from acquittal. 

It noted that an acquittal on the merits does not ipso facto trigger a claim for additional monetary relief unless statutory conditions are satisfied.

The ruling clarifies the limited scope of compensation under the Essential Commodities Act for released goods.
