Kerala High Court Upholds Reservation for Persons with Disabilities in Aided Institutions

  • Case Name: Samajam Higher Secondary School and Others v State of Kerala and Others

The Kerala High Court has upheld the 2018 Government Order mandating reservation for persons with benchmark disabilities in government-aided educational institutions.

The Court directed that a 3% reservation be implemented from February 7, 1996, under the Persons with Disabilities Act, 1995, and a 4% reservation from April 19, 2017, under the Rights of Persons with Disabilities Act, 2016. 

The court emphasized that administrative inconvenience cannot override statutory rights and ordered educational authorities to decide approval applications within one month.

The Court also approved filling reserved posts through the Employment Directorate, and should be made, excluding the posts for protected teacher vacancies. The matter is next listed before the Supreme Court.
