Allahabad HC: Associate Professors Not IT Act Experts for Electronic Evidence

The Allahabad HC ruled that Associate Professors of IT are not recognized as experts under Section 79-A of the IT Act, 2000 for examining electronic evidence. 

The case involved the selection process for various posts in UP Jal Nigam, where discrepancies in the CBT and question papers led to challenges. The court upheld the CFSL Hyderabad report, which identified 169 candidates who received undue advantage.

It was held that the evidence was inadmissible when not examined by IT Act experts, and decisions based on unexamined original records were unsustainable.

 The Court annulled the appointments of 169 candidates named in the CFSL report.
