Allahabad High Court Upholds Woman’s Right To Choose Her Life Partner

The Allahabad High Court condemned a father's and brother's objection to a 27-year-old woman marrying a man of her choice, calling it “despicable” and a violation of her Article 21.

Both sought to quash an FIR under Sections 140(3), 62, and 352 of the Bharatiya Nyaya Sanhita. While the Court stayed their arrest, it strictly barred them from contacting or threatening the woman or her husband.

Emphasizing the gap between constitutional values and social norms, the Court upheld an adult’s right to marry freely and restrained police from interfering.

The matter will be heard again on July 18.
