
The Allahabad High Court recently observed that individuals already married cannot legally enter into a live-in relationship with a third party without first obtaining a formal divorce.
Denying a protection plea filed by a couple, both married to different partners, who alleged threats to their lives.
The Court held that the right to personal liberty is not absolute and cannot encroach upon the statutory right of a spouse to their partner's company.
Noting that granting protection in such cases could amount to shielding an offence under the IPC. However, if subjected to actual violence, the petitioners may approach the police.
