
The Allahabad High Court dismissed Rahul Gandhi's petition challenging a Varanasi court order on FIR registration related to his remarks about religious freedom made in the United States regarding Sikhs.
The Varanasi court held that under Section 208 BNSS, sanction from the Central government is not needed for FIR registration or investigation, only for inquiry and trial.
The Court added that a magistrate must first determine whether a cognizable offence exists before ordering FIR registration.
The matter will now proceed before the magistrate.
