Allahabad HC Grants Bail in Controversial Rape Case, Citing Consensual Relation

The Allahabad High Court granted bail to a man accused of kidnapping and raping his sister-in-law. The woman claimed that her brother-in-law lured her with false marriage promises and assaulted her.

However, the defense argued the relationship was consensual, highlighting contradictions in her statements.

The court acknowledged that while the relationship was immoral, it did not qualify as rape since the woman willingly participated. As a result, the court granted bail to the accused, emphasizing that the nature of the relationship did not constitute a criminal act based on the available evidence.
