Allahabad High Court Refuses to Quash FIR Against RJD Member for Tearing Manusmriti Pages on Live TV

  • Case Name: Priyanka Bharti v State of UP and 3 Others

The Allahabad High Court refused to quash an FIR against RJD spokesperson and JNU Ph.D. student Priyanka Bharti, who allegedly tore pages of Manusmriti during a live TV debate on India TV and TV9 Bharatvarsh.

She was charged under Section 299 of the Bharatiya Nyaya Sanhita (BNS) for outraging religious feelings, a cognizable and non-bailable offence.

The court ruled that her actions showed deliberate intent and cited Supreme Court judgment in Amish Devgan's case on public figures' responsibility.

It rejected her argument of no malicious intent, emphasizing that influential individuals must be cautious with their actions and words.
