Allahabad HC Stays SHRC Orders on Child Custody Dispute

Allahabad HC Stays SHRC Orders on Child Custody Dispute

  • Case Name: Prabha Shankar Dwivedi vs. State of U.P
  • Judge(s): Justice Rajan Roy and Justice Brij Raj Singh

The Allahabad High Court stayed the State Human Rights Commission's (SHRC) orders regarding child custody, ruling that the SHRC lacked jurisdiction in such matters.

This decision arose after a mother died mysteriously on November 6, 2024, prompting her parents to file a criminal case against the husband and seek custody of the children.

The SHRC had intervened, ordering the children to be presented for statements. Currently, the High Court has allowed the deceased's parents to initiate separate custody proceedings while ensuring that these do not interfere with the ongoing criminal investigation, with a hearing scheduled in eight weeks.
