
The Allahabad High Court acquitted a 100-year-old accused in a murder case dating back to 1982, holding that the prosecution failed to prove the case beyond a reasonable doubt and that the accused was entitled to the benefit of doubt.
The case arose from an appeal against a conviction under Section 302 read with Section 34 of the IPC, where the appellant was alleged to have only exhorted the main accused, who was never apprehended.
The Court found contradictions in witness accounts, inconsistencies between ocular and medical evidence, omissions in the FIR, and noted that the appellant had remained on bail for nearly 40 years during the pendency of the appeal.
