Allahabad High Court Clarifies Satender Kumar Antil Ruling Applies Only After Charge-Sheet Is Filed

The Allahabad High Court, led by Justice Arun Kumar Singh Deshwal, observed that several district courts and advocates are misinterpreting the Supreme Court’s ruling in Satender Kumar Antil v. CBI, clarifying that its directions on bail apply only after a charge-sheet is filed and not during investigation.

The Court noted inconsistencies in medical evidence, including a CT scan showing a skull fracture while a later X-ray did not, suggesting possible manipulation of records. It imposed a cost of ₹10,000 on the concerned doctor and ordered an inquiry against the investigating officer.

The Court granted bail to the accused, citing the filed charge-sheet and absence of prior criminal history.
