
The Allahabad High Court has refused bail to a man accused of incitement, holding that the slogan “gustakh-e-nabi ki ek saza, sar tan se juda” constitutes a direct challenge to India’s sovereignty, integrity, and authority.
The Court observed that slogans prescribing punishments outside the framework of law undermine the constitutional and criminal justice system.
It emphasised that freedom of speech and assembly under Article 19 is not absolute and held that slogans inciting violence fall within permissible restrictions, constituting offences against the State.
