Allahabad HC refuses to quash case against man booked for saying brother was implicated because of religion

The Allahabad High Court has refused to provide relief to a man from Bijnour, who circulated a message claiming that his brother was accused in a false case due to the religion they follow. 

The Court observed that these actions amount to creating or promoting feelings of enmity or hatred between religious communities under Section 353(2) of the Bharatiya Nyaya Sanhita, 2023.

While the Counsel for the accused contended that the message portrayed his dissatisfaction with the arrest, the Court held that it conveyed a subtle message of arrest due to his religion.
