
The Allahabad High Court has dismissed a bail plea, terming it a misuse of judicial process due to the applicant’s counsel repeatedly failing to appear for over 1.5 years. Justice Krishan Pahal criticised the conduct as professional misconduct and “bench hunting.”
The Court noted that the trial was nearing conclusion and clarified that simply filing a bail plea does not create any legal right.
Citing previous judgments, the Court stressed responsible litigation, stating frivolous pleas burden limited judicial resources. Concluding that the applicant showed no genuine interest, the Court rejected the plea as infructuous. (Smt. Pooja vs. State of UP)
