Allahabad High Court Dismisses PIL Against Impeachment Motion on Justice SK Yadav

The Allahabad High Court dismissed a Public Interest Litigation challenging the impeachment motion moved by Kapil Sibal and 54 MPs against Justice Shekhar Kumar Yadav for his controversial remarks at a Vishwa Hindu Parishad event.

A Division Bench of Justices Attau Rahman Masoodi and Subhash Vidyarthi declared the PIL non-maintainable. Justice Yadav had used a slur against Muslims and stated India would function per the majority’s wishes.

Following criticism, his judicial work was curtailed to hearing first appeals filed before 2010.

The petitioner argued Yadav’s remarks reflected grievances and denied they qualified as hate speech.
