
The Allahabad High Court has held that a district magistrate’s certificate issued under Section 7 of the Transgender Persons (Protection of Rights) Act, 2019, constitutes conclusive proof of a transgender person’s gender for passport purposes.
A Bench of Atul Sreedharan and Siddharth Nandan ruled that passport authorities cannot insist on a fresh medical examination or additional documentation once a revised identity certificate is issued.
Quashing that direction, the Court held that the statute provides a complete mechanism for gender recognition and that “official documents,” including passports, must reflect the certificate without further scrutiny.
