The Kerala High Court ruled that allegations against a husband’s relatives under Section 498A of the IPC (Section-85 of BNS) cannot be dismissed as false without addressing them.
The complainant alleged physical and emotional abuse by her husband, his mother, and his brother. She claimed they demanded her to vacate their newly built home and threatened her after her parents moved in with her.
Justice A. Badharudeen stressed that vague and general claims lack merit but specific and clear allegations must be examined.
The Court dismissed the plea to quash proceedings, directing the mother-in-law and brother-in-law to face trial under Sections 498A and 506(i) IPC.
