Anantnag Sessions Judge Expunges Adverse Remarks Against Magistrate Due to Misidentification

Principal Sessions Judge Tahir Khurshid Raina of Anantnag, Jammu & Kashmir, has expunged adverse remarks made against Judicial Magistrate 1st Class (JMIC) Aishmuqam in a July 9 order.

The criticism was based on a December 2023 order that was mistakenly attributed to the current JMIC. Upon review, Judge Raina found that the order was authored by a previous incumbent

Acknowledging the error, Judge Raina invoked the legal maxim “Actus curiae neminem gravabit” (an act of the court shall prejudice no one) and emphasised that judges, being human, can make inadvertent mistakes.

The court directed that the corrected order be sent to the concerned court to ensure the record reflects the rectification.
