The Karnataka High Court ruled that anticipatory bail applications should first be filed in the Sessions Court unless exceptional circumstances justify approaching the High Court directly.
Justice Mohammad Nawaz dismissed school teacher Imran H’s plea, stating that while both courts have concurrent jurisdiction, bypassing the Sessions Court without valid reasons sets a wrong precedent.
The petitioner, accused under Sections 69, 318(2) of BNS, 2023, claimed false allegations and a threat to his life.
The court found no exceptional grounds and advised him to seek relief from the Sessions Court first, reserving his right to approach the High Court if needed.
