Appeal Under NIA Act Can't Be Dismissed on Ground of Limitation: Supreme Court

  • Case Name: Marfing Tamang @ Maaina Tamang v. National Capital Territory of Delhi (NCT)

The Supreme Court ruled that appeals under the National Investigation Agency (NIA) Act cannot be dismissed solely due to delays beyond the 90-day statutory period, as mandated under Section 21(5) of the National Investigation Agency (NIA) Act.

This landmark decision overrides statutory restrictions, affecting the validity of Section 21(5), and underscores the importance of substantive justice over procedural limitations.

Appeals can now be accepted even if filed after the prescribed period, providing relief to accused persons and victims seeking appellate redress.

The ruling is expected to ensure broader access to justice under the National Investigation Agency Act, of 2008.
