
Apple has approached the Delhi High Court challenging the Competition Commission of India's (CCI) practice of imposing penalties based on global turnover for antitrust violations.
The tech giant argues that such calculations create disproportionate fines that bear no rational connection to the Indian market, seeking judicial review of the penalty methodology applied to multinational corporations.
The challenge arises from the 2023 amendment to Explanation 2 of Section 27(b) of the Act, which expanded the definition of "turnover" to include "global turnover".The Union of India and the CCI have been arrayed as respondents.
The petition is listed for hearing before a Division Bench comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela on Wednesday.
