
The Delhi High Court has held that a bail application cannot be rejected solely on the ground that it is bulky or voluminous, stressing that courts must decide matters on substance rather than form.
The Court criticised the trial court for dismissing a bail plea in a POCSO case merely because it ran into nearly 500 pages.
The Court observed that the liberty of an accused cannot hinge on the length of pleadings and that, at most, courts may direct counsel to file a concise synopsis.
Setting aside the trial court’s order, the High Court remanded the matter for fresh consideration on merits.
