Bail Not Ordinarily Granted in Serious Offences: Supreme Court

  • Case Name: X v. State of Rajasthan and Another
  • Judge(s): Justices JB. Pardiwala and R Mahadevan

The Supreme Court criticized granting bail in serious cases like rape or murder based on discrepancies in the victim’s statement.

The Rajasthan High Court granted bail in a gang rape case despite pending testimonies of the victim and her mother, citing inconsistencies between the FIR and the victim's Section 164 CrPC statement.

The Supreme Court ruled such discrepancies insufficient for bail, directed the accused not to visit the victim's village during the trial, and imposed conditions against evidence tampering.
