The Bar Council of India (BCI) may take action against members of the Society of Indian Law Firms (SILF) for allegedly spreading false information about the entry of foreign law firms in India, calling them “misleading” and amounting to professional misconduct under the Advocates Act, 1961.
SILF had claimed that the new rules may harm Indian law firms. BCI clarified foreign lawyers can only offer advisory services, not appear in Indian courts under Rules 8(2)(b) and 8(2)(c).
The BCI emphasised that SILF represents less than 2% of Indian firms and lacks constitutional authority, asserting its mandate to regulate legal practice.
A formal notice may be issued to advocates responsible for the press releases, with possible disciplinary action such as suspension or removal
