
The Bombay High Court restrained The New Indian Express from using its mark in North and West India in a trademark infringement action filed by The Indian Express.
The Court held that the competing marks created a likelihood of confusion, particularly among readers who might mistake one publication for the other due to similarity in name and presentation.
Observing that The Indian Express enjoyed a prior and established reputation, the Court granted interim protection limiting The New Indian Express to its existing operations in South India. The bench directed compliance with the territorial restriction pending further proceedings, protecting the senior mark’s identity and market goodwill.
