Bombay HC Dismisses Lalit Modi’s Petition for Indemnity, Imposes Rs.1 Lakh cost

Lalit Kumar Modi, a businessman and former Vice President of BCCI, filed a writ petition under Article 226 seeking a writ of mandamus and indemnity for the Rs 10.65 crore penalty imposed by ED in 2018.
He claimed that under BCCI's rules, the board was obligated to indemnify him. The division bench of Justices MS Sonak and Jitendra Jain dismissed the petition, citing the Supreme Court's ruling in Zee Telefilms Ltd. v. UOI (2005), which excluded BCCI from the scope of the State under Article 12.
The court deemed the petition frivolous and imposed a Rs. 1 lakh cost, to be paid to Tata Memorial Hospital within 4 weeks.
