
The Bombay High Court granted bail to advocate Surendra Gadling in the 2018 Bhima Koregaon violence case.
A Division Bench of Justices AS Gadkari and Kamal Khata observed that Gadling has remained in custody for over eight years without the trial commencing.
The Court held that prolonged incarceration as an undertrial prisoner is a valid ground for relief. Despite this order, Gadling will remain in judicial custody due to his detention in the 2016 Surajgarh arson case under the UAPA.
Gadling was among the first arrested in 2018 before the investigation was transferred to the NIA.
