Bombay HC Imposed ₹5 Lakh Fine on Litigant for Challenging Judicial immunity law

The Bombay High Court fined a litigant Rs.5 Lakhs for indulging in forum shopping, misrepresentation, and suppressing facts while challenging the constitutional validity of judicial immunity under Section 3 of the Judges (Protection) Act, 1985.

Referring to the SC’s 2024 Dinesh Gupta decision, the Court emphasized that strict penalties, including fines up to Rs.25 lakhs, should be imposed for similar misconduct.

The Court noted that earlier NCLT proceedings had already been challenged in other cases, rendering the petition repetitive, and multiple petitions had caused unnecessary wastage of judicial time.

Consequently, HC dismissed the writ petition and imposed a fine of Rs.5 Lakhs.
