Bombay HC Orders Submission of Data on Forensic Lab Backlog

  • Case Name: Eduedge Pro Pvt. Ltd. v. State of Maharashtra
  • Judge(s): Justices Revati Mohite Dere and Advait Sethna
  • Advocate(s): Janhavi Karnik and Himanshu Kode

The Bombay HC has instructed the Additional Public Prosecutor to provide data on pending cases at the Forensic Science Laboratories (FSL) in Mumbai and Thane for the last five years.

The order came during a writ petition highlighting delays in forensic analysis, especially in cybercrime cases, and seeking the transfer of an investigation due to these delays.

The bench acknowledged the progress of a "semi-automatic" forensic project and the establishment of a "Center of Excellence in Digital Forensics."

Additionally, recruitment for 125 forensic staff is underway. The court has asked for detailed data on the backlog by January 29, 2025.
