
The Bombay High Court has directed a woman to provide her voice sample to verify her estranged husband’s claim of an alleged extramarital affair.
The Court observed that with the advent of technology, electronic evidence is increasingly replacing conventional evidence and emphasized the magistrate's authority to order such measures under Section 28(2) of the Protection of Women from Domestic Violence Act.
The husband had submitted audio recordings purportedly featuring his wife and her alleged paramour, seeking forensic verification.
After a magistrate rejected his plea, the High Court quashed that order, granting three weeks for the woman to comply. The voice sample will be sent to a forensic laboratory for analysis.
