
The Bombay High Court has denied anticipatory bail to two advocates accused of inducing a colleague to invest ₹30 lakh in intra-day trading with promises of 10–15% monthly returns.
Justice Amit Borkar observed that such guarantees are unrealistic and indicative of fraudulent intent from the outset, thereby attracting criminal liability under the Bharatiya Nyaya Sanhita, 2023.
The court emphasised that inducements based on false promises cannot be dismissed as mere civil disputes.
Despite partial repayments, the applicants failed to return the full amount, leading the court to reject their bail pleas.
