The Bombay High Court quashed a case under Section 498A IPC, noting the growing misuse of marital laws such as the Domestic Violence Act, Hindu Marriage Act, and Dowry Prohibition Act.
The Court observed that minor disputes are increasingly leading to criminal complaints, undermining the sanctity of Hindu marriages. It highlighted the practice of filing FIRs against multiple in-laws, resulting in emotional and financial distress.
Since the couple mutually dissolved their marriage, the Court held that to uphold their right to a peaceful life under Article 21, such cases should be quashed to promote amicable settlements.
