Bombay HC Stays Suspension of Woman Lawyer License Over Alleged Misconduct

  • Case Name: An Advocate v Bar Council of Maharashtra and Goa
  • Judge(s): Justices GS Kulkarni and Advait M Sethna

The Bombay High Court has put a hold on the Bar Council of India’s (BCI) decision to suspend a Woman lawyer's bar license for two years over alleged misconduct.

This suspension was based on a complaint from the Advocate Association of Western India (AAWI) regarding an incident from 2016.

The court criticized the BCI and the Bar Council of Maharashtra and Goa (BCMG) for ignoring principles of natural justice, pointing out delays in the process and a lack of fairness.

The judges stated that the advocate's rights under Articles 14, 19(1)(g), and 21 were violated, providing temporary relief while questioning the motives behind the complaint and the lengthy process.
