Bombay High Court acquitted 8 men in connection to the 2010 Wardha Gang Rape Case

The Bombay High Court, Nagpur Bench, acquitted 8 men earlier convicted in the Wardha Gang rape case of 2010, sentenced to 10 years in prison.

The Bench observed the victim, the woman and her mother, the star witnesses of the prosecution, did not support their case and turned hostile by stating the police statement was taken under pressure.

Justice Sanap marked DNA reports and forensic analysis as lacking procedural safeguards, the trial court's heavy reliance on the complainant's statement in 164 Cr.P.C even after the denial of her major portion of account in cross-examination.

The Court held statements based on unreliable and broken evidence the accused cannot be sentenced, condemned wrongful convention.
