Bombay HC: Candidate’s Involvement in Gambling Is Moral Turpitude, Cannot Be Considered for Public Service

The Bombay High Court has upheld the cancellation of a Clerk-Typist appointment in the City Civil Sessions Court, Mumbai, after the candidate, Jayesh Limje, was found guilty under Section 12A of the Bombay Prevention of Gambling Act, 1887, and had suppressed this fact in his application.

The Court held that involvement in gambling amounts to moral turpitude and undermines public trust, especially in the judiciary.

Suppression of material facts at the recruitment stage justified termination. The bench ruled that an employer cannot be compelled to appoint or retain such a person, dismissing Limje’s writ petition.
