Bombay High Court Clarifies Rules for Secondary Evidence Under Bharatiya Sakshya Adhiniyam

The Bombay High Court has ruled that parties seeking to submit secondary evidence under the Bharatiya Sakshya Adhiniyam, 2023 must first prove the existence and authenticity of the original document and demonstrate its loss or unavailability through diligent efforts.

The Court emphasised that mere assertions are insufficient; applicants must provide concrete proof of attempts to locate the original. This ensures the integrity of evidence and prevents misuse of procedural flexibility. 

The Court upheld the decision of the Central Government Industrial Tribunal (CGIT) refusing to allow Hindustan Petroleum Corporation Ltd. to lead secondary evidence.
