Bombay High Court Confirms Mandatory FASTag Policy for Toll Collection

The Bombay High Court rejected a petition against the mandatory use of FASTag at toll plazas, stating that it is a government policy designed to make road travel smoother and more efficient.

Arjun challenged NHAI’s February 12 & 14, 2021 circulars, arguing that double toll for non-FASTag vehicles was unfair, especially for those without bank accounts or tech knowledge, violating Article 19(1)(d) of the Constitution.

The Court held that the policy did not violate Article 19(1)(d) (freedom of movement) and was not arbitrary under judicial review principles.

The Court supported the policy, saying FASTag helps collect tolls smoothly and reduces traffic congestion.
