Bombay High Court Dismisses Case Against Kailash Kher Over ‘Babam Bam’ Song

The Bombay High Court has quashed criminal proceedings against singer Kailash Kher, rejecting claims that his song ‘Babam Bam’ offended Hindu religious sentiments.

The complaint, filed in Ludhiana, alleged that the song’s visuals—featuring dancers in modern attire—were inappropriate for a song about Lord Shiva.

A division bench ruled that Section 295A IPC requires deliberate and malicious intent, which was absent.

The court emphasized that freedom of expression cannot be curtailed merely because a section of people disliked the visuals.

Citing AG Noorani, the judges noted that intolerance toward dissent has long been an issue in Indian society.
