Bombay High Court Slams Police for Biased Probe, Quashes 498A Case Against Husband’s Family

  • Case Name: Ajay Rajendra Khare and Ors v State of Maharashtra and Ors

The Bombay High Court (Aurangabad Bench) quashed a dowry harassment case under Sections 498A, 323, 504, 506, and 34 IPC, criticising Maharashtra Police for a careless and one-sided investigation.

The FIR was filed by a woman against her husband and six in-laws. The Court noted that police failed to verify claims by visiting key locations like Kharghar and Manmad, and relied solely on the complainant’s family and ignored key evidence.

The Court also found inconsistencies in the woman’s claims, and suppression of her employment status.

The Court warned that such flawed probes undermine the cause of genuine victims.
