
The Bombay High Court granted a permanent injunction in favour of UltraTech Cement Limited and restrained a rival cement manufacturer from using marks such as “ULTRA PLUS,” “ULTRA HI-TOUCH,” and “ULTRA POWER.”
The Court held that the adoption of these marks was “entirely dishonest” and intended to unfairly benefit from UltraTech’s reputation and goodwill.
Justice Arif S. Doctor observed that the similarities in packaging, colour scheme, placement, and overall trade dress could not be treated as mere coincidence.
The Court also imposed more than ₹66 lakh towards litigation costs and expenses on the defendant for trademark infringement and passing off.
